Summary Administration is an accelerated form of probate available in certain circumstances. It is available when the total value of the probate estate is less than $75,000 or the decedent has been dead for more than two years. Under either scenario, however, a Formal Administration is required should the Last Will and Testament.
Summary Administration may prove to be a quick and relatively less expensive form of administration. However, there is no Personal Representative, which may raise some title difficulties. The Order of Summary Administration, however, is viable to demonstrate transfer of real property to the beneficiaries.
